Terms of Service

1. Introduction

These Terms of Service (the "Terms") govern the use of the mobile application "Kikotto" (the "App") provided by freewel (the "Provider"). By downloading or using the App, you agree to be bound by these Terms.

The App is intended for parents or guardians of children under 13 years of age.

2. Acceptance and Scope

By downloading or using the App, users agree to be bound by all provisions of these Terms. If you do not agree to these Terms, please do not use the App.

If a minor child uses the App, a parent or guardian must agree to these Terms and be responsible for supervising the child's use.

3. Relationship with Apple

You and the End-User must acknowledge that this EULA is concluded between You and the End-User only, and not with Apple, and You, not Apple, are solely responsible for the Licensed Application and content thereof. The EULA may not provide usage rules for Licensed Applications that conflict with Apple Media Services Terms and Conditions as of the Effective Date (which You acknowledge You have had the opportunity to review).

4. Usage License

The Provider grants users a non-exclusive, non-transferable, non-sublicensable license to use the App in accordance with these Terms. Users may use the App for personal purposes only.

This license is valid only on Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in Apple Media Services Terms and Conditions. Additionally, the App may be accessed and used by other accounts associated with the purchaser through Family Sharing or volume purchasing.

Users shall not engage in the following:

  • Reverse engineering, disassembly, or decompilation of the App
  • Modifying, translating, or creating derivative works of the App
  • Copying, selling, redistributing, or reposting the App
  • Circumventing technical protection measures that limit the App's functionality
  • Commercial use of the App

5. User Obligations

Users shall comply with the following obligations when using the App:

  • Comply with these Terms and applicable laws and regulations
  • Do not infringe upon the rights of third parties
  • Do not engage in conduct that causes discomfort to other users or the Provider
  • Register accurate information such as the child's age and personality
  • Use information generated from the App at your own responsibility

6. Prohibited Acts

Users shall not engage in the following activities in connection with the use of the App:

  • Acts that violate laws or public order and morals
  • Defamation, libel, or insults toward others
  • Providing false or misleading information
  • Infringing upon copyrights, trademarks, or other intellectual property rights of third parties
  • Harassment, stalking, or bullying
  • Transmitting computer viruses, unauthorized access, or system attacks
  • Interfering with the operation of the App
  • Other acts deemed inappropriate by the Provider

If the Provider determines that a user has engaged in prohibited acts, the Provider may suspend or delete the user's account without prior notice.

7. Intellectual Property Rights

All intellectual property rights related to the App and all content, text, images, software, designs, etc. contained therein belong to the Provider or third parties licensed to the Provider.

Users may use information obtained through the App only for personal use purposes as permitted under copyright law. Users may not reproduce, repost, sell, or otherwise distribute information from the App without authorization.

8. Privacy and Data Protection

The handling of user personal information shall be governed by the separate "Privacy Policy." By using the App, users are deemed to have agreed to the Privacy Policy.

9. Paid Features and Payments

Currently, the basic features of the App are available free of charge. If paid features (such as subscriptions) are added in the future, details will be announced in advance.

If paid features are offered, payments will be accepted only through Apple's App Store In-App Purchase (IAP). Charges are subject to Apple's Terms of Use.

If a subscription is purchased, auto-renewal will be enabled. To cancel a subscription, please do so through your device's "Settings".

Refund policies shall comply with Apple's App Store policies.

10. Disclaimer of Warranties

The App is provided "AS IS." The Provider makes no warranty regarding the functionality of the App, correction of errors, or system compatibility.

In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to the End-User; and that, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be your sole responsibility.

Specifically, but not limited to:

  • Warranty that the App is suitable for the user's specific purposes
  • Warranty that the App will operate without interruption or errors
  • Warranty that information contained in the App is accurate or up-to-date
  • Warranty of accuracy of advice provided through the use of the App

11. Product Claims

You and the End-User must acknowledge that You, not Apple, are solely responsible for addressing any claims of the End-User or any third party relating to the Licensed Application or the End-User's possession and/or use of that Licensed Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with Your Licensed Application's use of the HealthKit and HomeKit frameworks.

The EULA may not limit Your liability to the End-User beyond what is permitted by applicable law.

12. Maintenance and Support

You must be solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in the EULA, or as required under applicable law. If you have any questions or complaints regarding the Licensed Application, you must contact the Provider directly.

Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application. You acknowledge that Apple is not responsible for any obligations related to the App.

13. Modification and Discontinuation of Service

The Provider may modify, suspend, or discontinue all or part of the App without prior notice. Even if damages result to users, the Provider shall not be liable for compensation.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with Japanese law. Any disputes related to these Terms shall be subject to the exclusive jurisdiction of Tokyo District Court.

15. Legal Compliance

The End-User must represent and warrant that (i) he/she is not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) he/she is not listed on any U.S. Government list of prohibited or restricted parties.

16. Waiver

The Provider's failure to exercise any right or remedy under these Terms shall not constitute a waiver of such right or remedy. The Provider reserves the right to waive any right or remedy, either individually or collectively.

17. Severability

If any provision of these Terms is deemed invalid or unenforceable, that provision shall be interpreted to be valid to the extent possible, and the remaining provisions shall remain in full force and effect.

18. Third Party Beneficiary

You and the End-User must acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of this EULA, and that, upon the End-User's acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against the End-User as a third party beneficiary thereof.

19. Developer Information

The EULA must state Your name and address, and contact information (telephone number; E-mail address) to which any End-User questions, complaints, or claims with respect to the Licensed Application should be directed.
